Abstract

This chapter uses the historian’s method of micro-history to rethink the significance of the Supreme Court decision Muller v. Oregon (1908). Muller is typically considered a labor law decision permitting the regulation of women’s work hours. However, this chapter argues that through particular attention to the specific context in which the labor dispute took place – the laundry industry in Portland, Oregon – the Muller decision and underlying conflict should be understood as not only about sex-based labor rights but also about how the labor of laundry specifically involved race-based discrimination. This chapter investigates the most important conflicts behind the Muller decision, namely the entangled histories of white laundresses’ labor and labor activism in Portland, as well as the labor of their competitors – Chinese laundrymen. In so doing, this chapter offers an intersectional reading of Muller that incorporates regulations on Chinese laundries and places the decision in conversation with a long line of anti-Chinese laundry legislation on the West Coast, including that at issue in Yick Wo v. Hopkins (1886).

Abstract

The war between formidable rivals for the use of the word “Champagne” continues. It began in 1958 at the Old Bailey with a prosecution brought under the Merchandise Marks Act alleging the application of a false description, viz., “Spanish Champagne” to goods and a second charge of applying the false description “champagne.” For the prosecution it was stated that “champagne” could only come from the Champagne district of France, which in 1921 the French Government had officially established and limited as the sole area for the production of champagne. Such a description applied to a Spanish wine, therefore, was false and misleading. The prosecution failed. The judge had stated there was overwhelming evidence of wines having lost the territorial origin of their names.

Abstract

This chapter begins with a traditional, cultural story of indigenous leadership from a young woman of the Ngāti Awa tribe in the Bay of Plenty, New Zealand. Some would say her acts of leadership went against the traditional gender roles in order to ensure the safety of her people. Others would say she demonstrated the cultural duality between male and female leadership roles. We consider this story within the context of the ongoing marginalization and educational disparities faced by disproportionate numbers of indigenous Māori students in New Zealand’s secondary schools. If these students are to take their rightful place as successful and valuable contributors to society then education, as it is currently constituted, must be reimagined, reled, and reformed. We explore the pathway of critical, transformative leadership being undertaken by both Māori and non-Māori; by female and male; that is currently seeking to address the aspirations of Māori students in these schools. Such a model seeks to create “critical” spaces where the “creative potential” and diverse funds of cultural knowledge that Māori students bring with them to schooling can contribute to leading to more transformative educational reform.

Abstract

Much research has recently been conducted into the use of models for the economic design of multiple control charts (EDCC). Control chart models generally assume that most process variables are constant and only a limited number of the major variables are varied to reach a local optimum. In the economic design of multiple control charts (EDMCC), multiple control charts are used to analyse many manufacturing process variables simultaneously, in order to produce an optimal design for process control. However, the large number of variables often makes it difficult to solve this optimisation problem manually. This research explores the proposition that EDMCC can be optimised by using a novel genetic algorithm which dynamically adjusts the genetic algorithm’s (GA) operator and parameter settings during operation to ensure optimum effectiveness. This method involves refining the chromosome structure and using orthogonal arrays with fuzzy reasoning to reduce the search space.

Abstract

Saudi academic libraries (SALs) have been moving towards using electronic resources since 1992. This study aims to investigate the changes in electronic journal (EJ) (bibliographic and full‐text databases) and printed journal (PJ) collection and acquisition in terms of number of titles, type of provisions and acquisition budgets and costs, between the years 1995 and 2000. The survey method was used to obtain the data. The instruments used in this study were questionnaires that were distributed to six academic libraries in Saudi Arabia. The percentages were used to show the differences between the increase and the decrease of EJ and PJ collections and budgets. The most important findings show that the percentage of EJ collections sharply increased in 1996 by 98 percent, which corresponds to a high increase in their budget of 125 percent.

Abstract

Purpose

In 2019, the goal of developing a world-class open university through different stages was put forward by the Open University of China (OUC), which indicated that internationalization for Chinese open universities came to the agenda. However, international activities of open universities are different from those in conventional universities, and how to fulfill the goal of internationalization is a main issue faced by educators in Chinese open and distance education arena. This research aimed to identify ways of internationalization for the OUC system.

Design/methodology/approach

A survey was employed as a tool to get feedback from target audience. A questionnaire was released to academics, management staff and researchers to the 44 provincial open universities. A total of 501 samples were collected. Among them, 332 were from academics, which accounted for 66.27%, 152 were from school-level directors and 17 were from university-level leaders.

Findings

By analyzing the data collected in the survey, the study proposes four recommendations to fulfill the goal of internationalization for Chinese open universities and these include strengthening top-level strategies, building up professional teams, sharing learning resources and delivering upper-level programs.

Research limitations/implications

The targets of this research were all staff at different levels in the central and local institutions; no students were included in the research. Therefore, this did not reflect a picture from the student perspective, and this will be improved in future research.

Originality/value

Since the establishment of the OUC in 1979, there has been no clear and systematic pathways for the development of internationalization of Chinese open universities. This research proposes a theoretical framework of internationalization for open universities and suggests a direction for future development.

Abstract

Purpose

In this study, the authors seek to examine the prevalence and relationships between constructs of mindfulness, task autonomy, inter‐functional coordination, teamwork, contract implementation and monitoring which have been largely ignored or not fully explored in previous empirical research; and attempt to use them to predict contract performance.

Design/methodology/approach

The paper uses descriptive and analytical research designs guided by multi‐methods qualitative and quantitative research approaches to collect and analyze data predicting contract performance in the Common Market for Eastern and Southern Africa (COMESA) member states. Data was collected from a representative sample of ten countries and subsequent sampling was done at the government ministries. Contracts were the unit of analysis as suggested by Brousseau and Glachant.

Findings

The study findings reveal that deontology, mindfulness procurement task performance, competence of the procurement staff, inter‐functional coordination and teamwork, mindfulness, task autonomy, inter‐functional coordination, teamwork, contract implementation and monitoring for contract implementation and monitoring significantly and positively predict contract performance. Contrary to the authors’ expectation, teleology ethical orientation and autonomy of procurement staff significantly and negatively predicted contract performance. These findings have both policy and managerial implications which the authors present.

Originality/value

Lastly, the authors recognize the virtue of ethical orientation of PDE leadership which resides in deontology and teleology that has been largely ignored in previous contract performance research. Paralleling previous empirical studies, the study brings together constructs of mindfulness, task autonomy, inter‐functional coordination and teamwork, contract implementation and monitoring in predicting contract performance in a large regional sub‐Saharan market of the Common Market for Eastern and Southern Africa (COMESA).
